In the case of the Philadelphia, Baltimore and Washington Railroad Company v. The Mayor and City Council of Baltimore, ante, page 504, the validity of benefit assessments made by the Commissioners • for Opening Streets in connection with the opening of a highway over Jones’ Falls in Baltimore City was sustained as against the objections there under consideration. The present appeal is from an order refusing a preliminary injunction upon a bill of complaint which disputes upon other grounds the right of the Commissioners to make such assessments.
