OPINION

ROGERS, Circuit Judge.

Petitioner James Washington appeals the district court’s order denying his habe-as petition. A Michigan jury found Washington guilty of first-degree murder and possession of a firearm during the commission of a felony. He was sentenced to life in prison. On direct appeal, the Michigan Court of Appeals affirmed his convictions. Although Washington moved for and was denied an evidentiary hearing, the state appellate court denied his ineffective-assistance-of-eounsel and defense-participation claims “[bjecause defendant failed to move for an evidentiary hearing” and…
