The appellants, Edward McCarthy et- al., were the plaintiffs in the court below in an action of trespass to try title, involving the Eduardo Arriola league of land in Hardin county, Tex. This suit was filed on the 22d day of January, 1917, against Houston Oil Company of Texas, W. A. Bill-ingsley et al., and was tried during the month of April, 1919. Plaintiffs’ petition was in the usual form, and, in addition, they specially pleaded three, five, and ten years’ limitation.
