hi respectfully dissent in part and concur in part.1 I would stay this proceeding to allow the Louisiana Supreme Court the opportunity to address a limited systemic problem in the allotment procedure employed in Orleans Parish Criminal District Court that I find does not rise to the level of an individual due process violation on the part of the defendant, Tyrone Brown, but nonetheless undermines the public’s confidence in the criminal justice system.

I agree with the majority that the allotment procedure employed in this case does “invite manipulation” by the district attorney’s office.…
