On the original hearing we sustained an exception of lack of interest in the plaintiffs and dismissed their suit. Our reconsideration of the case has convinced us we erred in so doing.
Plaintiffs attack the contract between the police jury and the defendant Standard Highway Company, Inc., as illegal and prejudicial to them. They show the creation of the fund by the taxpayers of the road district for the purpose of constructing roads in said district, and they aver the pledge, under the law, without limit of their property and the property of other taxpayers to continue…
