This case arose on a protest filed by J. M.'Davis to the return of processioners in a proceeding instituted by H. G. Terrell Jr., to have the dividing line between himsélf and Davis established and marked anew. A verdict was returned against '.the protestant, who made a motion for new trial, which was overruled j and error is assigned on that judgment. '

The gist of Davis’s objections to the return of the processioners was that the dividing line set up by the processioners was not the true and correct dividing line between himself and Terrell. The line in dispute is the north and south line…
