This was a proceeding for execution against a stockholder under the provisions of Revised Statutes, 1879, section 736. R. S. 1889, sec. 2517. There-were three defenses set up by an amended answer. The first was a general denial. The other two were as follows :

“For another and further defense this defendant says that he subscribed about the-day of May, 1888, for one hundred (100) shares of stock in the Thompson Manufacturing- Company, which subscription was made, not for himself but for the Scott Investment Company, a corporation ; and that said Scott Investment Company was the real party in…
