This is an appeal from an order of the district court granting defendants’ motion for summary judgment.
We wish to preface our discussion of this case by stating that this is an action brought by an employee against third persons whom such employee alleges caused the injuries which he received in the course of his employment, as permitted by section 92-204, R.C.M.1947, a part of the workmen’s compensation act.
