The plaintiff in error was indicted at the October term, A. D. 1852, of the Circuit Court of Grant County, under the latter clause of section fourteen of chapter one hundred and thirty-five, of the Revised Statutes, for uttering counterfeit coin. The indictment contained two counts, in each of which the defendant is charged with having uttered and paid' out the counterfeit coin “ unlawfully, unjustly and deceitfully,” to one Amos Chase, he, the defendant, well knowing the said coin “to he false and counterfeit.” The first count charges the uttering to he with intent…
