Action to recover damages for breach of contract to deliver four cows claimed to have been purchased by the plaintiff, brought to the City Court of New Haven and tried to the court, Bishop, J.; facts found and judgment rendered for the plaintiff, and appeal by the defendant for alleged errors in the rulings of the court. The plaintiff, a butcher, bought of the defendant, a farmer, four cows for $72. At the time of the purchase the plaintiff paid $10 on account of the purchase price, and agreed to pay the balance when he took the cows. He agreed to take them within a week. A memorandum in the form of an ordinary bill, for four cows at $72 and a credit of $10 cash and showing $62 due, was made out, signed by the parties and delivered to the plaintiff.
