OVERTON, J.

Defendant was charged with the larceny of property, goods and chattels of the value of $35. He was found guilty of the larceny of merchandise of the value of $17.50, and sentenced to jail for the period of six months. The state moves to dismiss the appeal on the ground that the penalty actually imposed by the sentence does not exceed six months in jail, and that a fine was not imposed exceeding $300.

Section 10 of article 7 of the Constitution of 1921 fixes the appellate jurisdiction of this court, in criminal cases, as follows:
