Appealing the judgment of the Virginia Workers’ Compensation Commission * denying him workers’ compensation benefits, Evelio Watford contends that the commission erred (1) in holding that the employer met its burden of proof under Code § 65.1-38(4), (2) in holding that Colonial Williamsburg Foundation (the employer) gave the notice of defense required by Rule 4 of the Rules of the Industrial Commission, and (3) in finding that the appellant was guilty of willful misconduct which justified the denial of compensation benefits to him.
