Presently before the Court is an appeal by American General Finance, Inc., from a decision of the United States Bankruptcy Court for the Middle District of Georgia, Athens Division. The primary issue on this appeal involves the question of what interest rate a creditor is entitled to as part of a “cram down” under Chapter 13 of the United States Bankruptcy Code. For the reasons that follow, this Court believes that the Bankruptcy Court used an acceptable method for selecting the applicable interest rate in a Chapter 13 cram down, and for that reason, the decision of…
