English, Ch. J.:

At the August Term, 1877, of the Circuit Court of Clay County, the prosecuting attorney filed a motion, in the name of the State, to suspend from office until the next term, unless a trial could be sooner had, Edward M. Allen, the sheriff and col- ■ lector of the county, because four bills of indictment, therewith shown to the court, had been regularly returned into court and filed against him by the grand jury, numbered, etc., charging him with high crimes, felonies, incompetency and misdemeanors in office.
