On the first day of January, 1881, and also at the institution of this suit, W. A. Smith and J. H. Collett, the appellees, each owned an undivided one-half interest in the Sarah Ford headright six hundred and forty acre survey, situated in Brown county; unless the title to Smith’s interest, or a part of it, had been by virtue of certain tax proceeding hereafter considered, divested out of him and vested in W.
