This is the second appearance of this case before us. In Henry v. Blankenship, 1 we affirmed the trial court’s grant of summary judgment to Milton Blankenship, the holder of an option to buy Clifford Henry’s 28-acre parcel of land, on Henry’s counterclaim for fraud, but reversed the trial court’s grant on Henry’s counterclaim for breach of contract and Blankenship’s own claim for specific performance. 2 On remand, the trial court again granted Blankenship summary judgment on Henry’s counterclaim.
