— Appeal from a judgment of the Supreme Court at Special Term (Prior, Jr., J.), entered April 1, 1983 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination of the Division of Licensing of the Department of State denying petitioner’s request for appointment as a notary public. Petitioner, a convicted predicate felon, is presently an inmate at the Attica Correctional Facility serving a term of imprisonment of IV2 to 15 years.
