This is an appeal by plaintiff, as administrator of the estate of decedent, from a judgment of the trial court granting summary judgment in favor of defendant. Plaintiff brought a four-count complaint against defendant Palumbo Excavating Company seeking to recover damages for the death of decedent, Marvin Lamont Humbert. Plaintiff’s complaint alleged specific acts of negligence and violation of the Illinois Structural Work Act (HI. Rev. Stat. 1987, ch. 48, pars. 60 through 69).
