YEAKEL, Justice.
Appellants Hays County Water Planning Partnership, a political and environmental group of Hays County taxpayers concerned about real estate development in Hays County, and Erin Foster, its chairman, (together “HCWPP”) appeal from the district court’s summary judgment in favor of appellee, Hays County, Texas. We will reverse the district court’s sum mary judgment and remand the ease to that court.
