Nathan Ratcliff, the pledgee of a mortgage note which was not paid at its maturity, caused executory process to issue thereon, and the property affected by the mortgage was seized and advertised for sale. The relatrix, as third opponent, petitioned the district court for a temporary injunction to restrain the sale of the property and prayed that the injunction be perpetuated, and for a judgment ordering Ratcliff to deliver to her, as the owner thereof, the note upon which the executory process was based.
