Plaintiff, Gemini Investors Inc. (“Gemini”), commenced a breach of contract suit against Ameripark, Inc. (“Ameripark”) in the Superior Court for Norfolk County, Massachusetts on July 25, 2007. Ameri-park subsequently removed this suit to the United States District Court for the District of Massachusetts pursuant to 28 U.S.C. § § 1332, 1441, and 1446.
