Reversing.
Prior to June 20,1923, and up to and including about the middle of March, 1925, the firm of Broaddus, Forbes & Co., composed of W. W. Broaddus, H. De B. Forbes, and Shearer Eads, operated a mercantile business in Madison county, a part of which wás the handling and selling of building material. In the fall of 1924 appellant and defendant below, Frances Tate Forbes, who was and is the wife of the partner, H. De B.
