The defendants appeal from an order denying their motion to vacate and set aside a journal entry of judgment.

An opinion was rendered in this case in The State, ex rel., v. City of Stafford, 92 Kan. 343, 140 Pac. 868. At that time the case was presented to this court on a single question — that there was no evidence to support the finding of the trial court that $2200 of the amount paid to the Larabee Light & Power Company was for the surrender of its franchise.
