In a proceeding pursuant to *569CPLR article 78 to review a determination upholding the denial of a permit to petitioner to repair fire damage to its building, the appeal is from a judgment of the Supreme Court, Nassau County, entered November 21, 1979, which annulled the determination and directed that a permit be issued to the petitioner. Judgment reversed, on the law, without costs or disbursements, determination confirmed and petition dismissed on the merits.
