By McBRIDE, J:

This action is a civil suit involving a motor vehicle accident which took place March 22, 1947 at the intersection of the Taylorsburg-Englewood Road with the Wenger Road in Montgomery County, Ohio. The plaintiff, Nevin G. Hoover, was operating his vehicle in a northerly direction at a time when the defendant, Otha Blackmore, was approaching the same intersection in a westerly direction on the Wenger Road.
