LINDLEY, District Judge.

Isabel A. Hartl, administratrix of the estate of Adolph Hartl, deceased, appellant, brought this action against appellee to recover damages for the death of her intestate caused by collision of a truck driven by the latter, with a north-hound train of appellee. At the close of appellant’s evidence, the trial court instructed the jury to return a verdict for appellee, and from the judgment rendered on such verdict appellant appeals.
