ORDER
MOODY, District Judge.
This matter comes before the court on a Motion for Summary Judgment which the defendants filed on June 27, 1986. The plaintiffs filed a brief in opposition on September 8, 1986 to which the defendant replied on September 29, 1986. For reasons discussed below, the defendants’ Motion to Strike the affidavit of Spiro J. Kouvakas is DENIED and the defendants’ Motion for Summary Judgment is GRANTED.
