In June, 1905, the plaintiffs leased, by agreement in writing, a tract of land and mortar mixing plant, for the *86term of three years from July 1, 1905, and under that lease the defendant went into possession of the premises and continued to enjoy such possession for at least two years and a half. The defendant while seemingly entirely willing to use the property exhibited a consistent disinclination to pay rent and litigation naturally resulted.
