*682In an action to recover damages for personal injuries, etc., the defendant Diamond Sugar Co., Inc., appeals from (1) an order of the Supreme Court, Kings County (Douglass, J.), dated October 6, 2004, and (2) an amended order of the same court dated December 1, 2004, which denied its motion pursuant to CPLR 3211 (a) (1) and (5) to dismiss the complaint insofar as asserted against it.
Ordered that the appeal from the order dated October 6, 2004 is dismissed, as that order was superseded by the amended order dated December 1, 2004; and it is further,
