This suit was filed by respondent, administratrix, to recover damages for the death of her husband, Arthur H. Wolf, who lost his life, on December 9, 1937, when one of defendant's passenger trains struck a mill truck driven by deceased. The accident occurred at a crossing located about one and one-half miles south of Alhambra, Illinois. A trial in the Circuit Court of the City of St. Louis resulted in a judgment of $10,000 in favor of plaintiff on the first count, and on the second count $500 for damages to the truck. From the judgment entered the defendant railroad appealed.
