This is an action of ejectment to recover the .possession of five forty-acre tracts of land, less about eighteen acres off the south side of the tract. On the trial the evidence showed that J. L. Myers, the deceased, had purchased from the government all' the lands in question, except two forty-acre tracts, and that these two tracts were purchased from the government in the name of his son, 0. 0.
