Defendant was found guilty by a district court jury of charges of simple assault and aggravated assault, Minn.Stat. §§ 609.22 and 609.225, subd. 2 (1978), and was sentenced by the trial court to concurrent terms of ninety days and five years in prison. The issues raised by defendant on this direct appeal relate to (1) the admission of evidence of other misconduct by defendant earlier in the evening of the assaults, (2) the admission of a prior conviction to impeach defendant and the lack of a cautionary instruction for the use of this evidence, (3) the suppression of the…
