(dissenting). My opinion is that the decree dismissing this appeal is contrary to the spirit, if not the very letter, of Act 112 of 1916, p. 241, which, by its broad scope, was intended to make impossible such a hardship ns this decree will impose upon the appellant. I am also of the opinion that the decree is contrary to the established jurisprudence of this court on the subject, regardless of the statute of 1916.
