This matter is before the Court on Co-rus Construction Venture, LLC’s (CCV) Motion for Partial Summary Judgment which seeks a declaratory judgment that defendants Jonathan R. Adkins, et al. and defendants Peter Bell, et al. (collectively, the “Original Purchasers”) are not entitled to an equitable lien on the Project Assets 1 and even if they are, that their lien is subordinate to both the CCV’s Mortgage and the DIP Lien.
