JANVIER, Judge.

On March 8, 1939, at about 12 o’clock noon, Evelyn Miller, plaintiff, after boarding one of defendant’s electric street cars, fell to the floor of the car and sustained injuries. Seeking recovery from defendant, in her petition she made the following charge: “That the sole and only cause of her fall, and her resulting injuries, was the carelessness of the motorman and/or conductor of your defendant corporation in that said conductor gave the signal to start said street car while your petitioner was in a precarious position with nothing to hold on to; further that the motorman…
