A brief history of this case is necessary to fully understand the questions involved. On the 16th of March, 1904, Segundo Setty,- acting as agent for the-American Railroad Company of Porto Rico, brought an action in the'Municipal Court of San Juan against Francisco Hernández for damages *493in the sum of $116.10, caused by an ox belonging to the said Francisco Hernández straying upon the track of the said railway company and derailing the engine thereof, and damaging* the said engine and also the railroad track, and delaying the passenger train.
