I. INTRODUCTION

This appeal is from a jury verdict finding that Defendant St. Paul Mercury Insurance Company (St. Paul) unreasonably delayed or denied payment of insurance benefits to Plaintiff Home Loan Investment Company (Home Loan) in violation of Colorado law. Following trial, St. Paul moved for judgment as a matter of law (JMOL) under Rule 50(b) or, alternatively, for a new trial under Rule 59(a) of the Federal Rules of Civil Procedure.
