This case is before the court on defendant’s bill of exceptions. It was tried in May, 1915, and there was a verdict for the plaintiff for $3,000. There had been two previous trials and in both verdicts were rendered for the plaintiff, each of which on motion was set aside by the trial judge, in the first instance without any statement of the reason therefor, in the second because it was held to be against the evidence. The verdict at the third trial was upheld by the trial judge by denying a motion for a new trial in a rescript which briefly considers the question of liability and discusses…
