The appeal of A. M. Culpepper in the above-numbered cause was decided at a former day of this court and a judgment rendered dismissing D. B. Holmes was affirmed. 154 So. 726.

In the appeal of A. M. Culpepper against D. B. Holmes, the appeal bond showed an appeal from a judgment dismissing Holmes. There were cross-assignments of error filed by Donald McLean challenging the correctness of the judgment against him.
