This is an action by Gladys Harris, individually and as natural tutrix of her two minor children, for the recovery of death benefits, penalties, interest, and attorney’s fees allegedly due under the Louisiana Worker’s Compensation Act as a result of the death of her husband. The defendants herein are the employer, Trailways Southern Lines, Inc. (Trailways), and its insurer, Liberty Mutual Insurance Company (insurer). The district court rendered judgment in favor of the plaintiff as to the death benefits, but declined to impose upon the defendants the statutory penalties and…
