This is an appeal from a judgment of conviction for the crime of burglary in the second degree and persistent violator of law; the charge being, that defendant (appellant herein) "did then and there. . . enter in the daytime that certain dwelling house. . . in Caldwell. . . the same being the residence of L.A. McBride, with the intent then and there to commit larceny therein". The property supposedly stolen was a "bill fold, with enclosures".
