Appeal by the defendant, Theodore Shanley, from a judgment of the County Court of Bichmond county in favor of the plaintiff, rendered on the 761 day of December, 1899, upon the verdict of a, jury convicting him of the crime of assault in the first degree.

Hatch, J.:

The evidence was amply sufficient to sustain the charge contained in the indictment and justified the conviction of the defendant thereunder. The shooting upon which the conviction was predicated *57was admitted, and the answer made thereto was a justification that it was done in self-defense. . The only question upon which error is claimed arose upon the proceedings had upon the trial and in the submission of the case by the court to the jury.
