*743In an action to recover damages for breach of contract, the plaintiff appeals, as limited by its brief, from so much of an order of the Supreme Court, Suffolk County (Weber, J.), dated January 18, 2007, as granted the defendants’ motion to dismiss the complaint pursuant to CPLR 3211 (a) (3) and Business Corporation Law § 1312 (a).

Ordered that the order is affirmed insofar as appealed from, with costs.
