Roger Touhy, relator in the court below, sued out a writ of habeas corpus against Joseph E, Ragen, Warden of the Illinois State Penitentiary, Joliet, Illinois, respondent in the court below, on the ground that he had been unlawfully convicted and was being illegally detained by respondent in violation of relator’s constitutional rights.
