MARTIN, Judge.

Defendant was indicted for the first degree murder of Paul Solis and for being a violent habitual felon. He appeals from a judgment sentencing him to life imprisonment without parole entered upon jury verdicts finding him guilty of second degree murder and being a violent habitual felon.

The evidence presented at trial indicates that at about 10:30 or 11:00 p.m. on 3 August 1999 Paul Solis was shot and killed by defendant in the back parking lot of the Korner Pocket, a pool hall in Raleigh, N.C. Testimony by various witnesses indicated that defendant and Solis were friends prior…
