Maxwell, Judge:

L. H. Sedinger, committee for E. D. Swaney, a convict, prosecutes this appeal to an order of the state compensation commissioner refusing compensation to Swaney for injuries sustained to his right eye on the 15th day of November, 1928, while in the employ of Crystal Coal & Coke Company.

On the day stated claimant was struck in his right eye by some falling coal. He left the mine immediately, and went for medical attention to the company physician, Dr. Dana T. Moore, who administered temporary treatment and sent the patient to Drs. Davis & Holcomb, eye specialists at Logan. In…
