MEMORANDUM OPINION AND ORDER

PLUNKETT, District Judge.

Pending are cross-motions for summary judgment. For the following reasons, we deny Plaintiff’s motion and grant Defendant's motion.

Facts

This lawsuit arises like a phoenix from the ashes of an earlier lawsuit in the Circuit Court of Cook County, Illinois, Tannebaum, et al. v. Northwest Hospital, Inc., et al., No. 75 L 21023.
