{¶ 1} Appellant, James Were, challenges the denial of his application to reopen his direct appeal pursuant to App.R. 26(B).

{¶ 2} Appellant was convicted of, and sentenced to death for, the aggravated murder of Corrections Officer Robert Vallandingham during the inmate riot at *86the Southern Ohio Correctional Facility (“SOCF”) in April 1993. The court of appeals affirmed his convictions and death sentence. State v. Were, Hamilton App. No. C-030485, 2005-Ohio-376, 2005 WL 267671, and 2006-Ohio-3511, 2006 WL 1867840.
