Petitioner was convicted of a felony on November 2,1928, in Queens County Court and sentenced to a definite *431term of ten years. He was received in State prison on November 5,1928, and with a credit of fifteen days’ jail time, his term would expire on October 19, 1938. On August 8, 1934, the petitioner was paroled pursuant to the terms of a conditional commutation of seiitence granted by the Governor of the State of New York, the pertinent conditions of which are hereinafter outlined.
