GRAVES, Presiding Judge.

Appellant was convicted as a second offender of the illegal transportaron of intoxicating liquor in a dry area, and was by the jury assessed a penalty of $2,000.00 fine and 18 months in jail.

We take a resume of the facts from the state’s brief as follows:

“At about 5 o’clock in the morning on the date of appellant’s arrest he was observed by police officers driving his automobile on a public highway at a high rate of speed.
